Volunteer release and Waiver of liability

NOTICE:  By agreeing to this document, you relinquish your right to bring any claims or actions to recover any damages, losses or compensation against Fences for Fido, an Oregon nonprofit corporation (“Organization”) and its members, directors, officers, employees, contractors, agents and representatives (“Released Parties”), as a result of any injury to person or property arising out of or related to volunteer activities for the Organization. I, “Volunteer” desire to work as a volunteer and engage in the activities related to being a volunteer with the Organization.    I understand that the activities may include but are not limited to traveling to locations in and around Oregon and Washington, constructing and repairing fencing and enclosures, and performing other construction‐related activities.    I hereby freely and voluntarily, without duress, execute this Agreement under the following terms:

1. Waiver and Release.  

I, the Volunteer, release and forever discharge and hold harmless the Organization and its successors and assigns from any and all liability, claims and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my work for the Organization.  I understand and acknowledge that this Agreement discharges the Organization from any liability or claim that I, the Volunteer, may have against the Organization with respect to any bodily injury, personal injury, illness, death or property damage that may result from my participation in the activities of the Organization, whether caused by the negligence of the Organization or its directors, officers, employees, or agents or otherwise.  I also understand that the Organization does not assume any responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance, in the event of injury, illness, death or property damage.
 

2. Insurance and Medical Treatment.  

I, the Volunteer, understand that the Organization does not carry or maintain health, medical or disability insurance coverage for any volunteer.  I hereby release and forever discharge the Organization from any claim whatsoever that arises or may hereafter arise on account of any first‐aid treatment or other medical services rendered in connection with an emergency during my participation in the activities of the Organization.

3. Assumption of Risk.  

Understand that my time with the Organization will include activities that are inherently hazardous, including, but not limited to, construction activities, loading and unloading heavy equipment and materials, and local travel to and from the project sites.    I hereby expressly and specifically assume the risk of injury or harm in these activities and release the Organization from all liability for injury, illness, death, or property damage resulting from time with the Organization.

4. Photographs/Video.

I grant to Fences For Fido, the irrevocable and unrestricted right to use and publish photographs of me, or in which I may be included, without my inspection or approval.    I hereby release Fences For Fido from all claims and liability relating to said photographs and videos.

5. Other. 

I expressly agree that this Agreement is intended to be as broad and inclusive as permitted by the laws of the states of Oregon and Washington in the United States of America, and that this Agreement shall be governed by and interpreted in accordance with the laws of the states of Oregon and Washington.  I agree that in the event that any clause or provision of this Agreement shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Agreement, which shall continue to be enforceable.
